What Happens After I Get Arrested? How Soon Can I Get Out of Jail?

So you got arrested somewhere in Michigan. A cop pulled you over, or showed up at your home, and slapped a pair of cuffs on you and dragged you off to the Ingham County Jail. (Or the Kent County Jail, or perhaps the Oakland County Jail – it all depends on where in Michigan the arrest happened.) That has got to be one of the worst feelings in the world. That frightening moment when the handcuffs squeezed your wrists and you suddenly lost your freedom. The terrifying ride in the back of the police car. And the humiliating way you were processed back at the police station before being tossed behind bars. Everything about it is awful. But what now? Now that you’ve been arrested, what happens next? And how soon can you be back home with your loved ones and out of that terrible place?

What happens next depends on what happened before the arrest…

In some ways, what happens next will be directly affected by what happened at the time of the arrest, and what led up to the arrest. For example, if you’ve been charged with murder, you’re far less likley to get the opportunity to post bail, than if you were arrested for shoplifting. In fact, our Constitution guarantees the right to post bail in all cases except the most serious of offenses. Also, the way the police handled the arrest can have an impact on what happens next. For example, you have certain Constitutional rights (like your Miranda rights, and your right to speak to an attorney) that come into play when you get arrested, and if they’re violated that can affect what happens next. What you should and shouldn’t do now is extremely important!

Another thing that impacts what happens next is the choices you make from the time of the arrest onward. Try to fight the cops while they’re arresting you, or try to run away, and you’re likely to end up facing even more charges and the prosecutor will probably use it against you in court, which could make it harder for you to get a reasonable bail. But the worst thing you could possibly do right now is talk to anyone but your attorney! That’s right – your best option is keeping your mouth shut! DON’T answer any questions, or talk to the cops, or try to explain anything. There might be a predetermined interim bail amount that has been set. If so, your family can post that bail (which is the same thing as “bond”) and then you go home. If there is not already a predetermined amount of bail, you’ll have to wait to see a judge or magistrate to hear what your bond will be. Once that’s done, you or your family or a bail bondsman can post your bail and you get to go home. 

What you can expect when you arrive at the county jail:

Then all of your information is entered into the police database, you’re searched, photographed and fingerprinted, and your personal items are taken away (including your clothes – because this is the part where you get that classy orange jumpsuit.) Once you’ve been processed you’ll be able to make that call.
