What is Home Invasion in the first degree?

First degree Home Invasion is the most serious version of this offense. This law replaced common law burglary, giving some clear definitions and making the law easier for prosecutors to apply. This is a felony with a maximum penalty of 20 years in prison or a fine of up to $5,000.00, or both.

Prosecutors must prove the following beyond a reasonable doubt for a conviction to result:

First, the defendant either

  • Breaks and enters a dwelling, OR
  • Enters a dwelling without permission.

Second, the defendant either

  • Intends when entering to commit a felony, larceny, or assault in the dwelling, OR
  • At any time while entering, present in, or exiting the dwelling commits a felony, larceny, or assault.

Third, while the defendant is entering, present in, or exiting the dwelling, either

  • The defendant is armed with a dangerous weapon or
  • Another person is lawfully present in the dwelling.
