Sexual Extortion and Aggravated Sexual Extortion in Michigan Law

As of April 2, 2025, Michigan’s Penal Code will include new provisions that specifically address the crimes of sexual extortion and aggravated sexual extortion. These changes, brought about by Public Act 261 of 2024, are intended to strengthen the state’s legal framework around sexual exploitation and provide more severe penalties for offenders. What is Sexual Extortion?

• Second Offense: A felony punishable by up to 10 years in prison.
• Third or Subsequent Offense: A felony punishable by up to 20 years in prison.

If the victim of sexual extortion is less than 18 years of age, or if the victim is a vulnerable adult (defined as someone who is unable to care for themselves due to physical or mental limitations), and the perpetrator is more than 18 years old, the crime is classified as aggravated sexual extortion. This offense is punishable by a felony conviction carrying a maximum sentence of up to 25 years in prison.

Aggravated Sexual Extortion (Serious Harm or Death)

In the most severe cases, if the victim suffers serious physical harm, serious mental harm, or even death as a result of the sexual extortion, the offense is considered aggravated sexual extortion. Those convicted under these circumstances also face up to 25 years in prison.

What is Considered ā€œSerious Harmā€?

The law provides specific definitions for what constitutes “serious harm” in the context of aggravated sexual extortion. These include:
• Serious Physical Harm: A physical injury that threatens the victim’s life, causes substantial bodily disfigurement, or significantly impairs the victim’s bodily functions
• Serious Mental Harm: A mental injury that results in a substantial alteration of the victim’s mental functioning and is visibly demonstrable.
