What You Need to Know About Michigan’s New Vaping Law (Pt 2)

Vaping is legal in Michigan, but flavored vape products are now banned! So be careful what vaping accessories you buy and sell in the future!

Welcome back and thanks for joining us for the rest of this discussion on Michigan’s new vaping laws. As we mentioned in the previous article, Michigan Governor Whitmer declared vaping a public health emergency and has banned all flavored vape products. Michigan is now the first state in the U.S. to have a law against certain vaping products, which may or may not set a precedent for other states (we’ll have to wait and see on that one.) But how did the people of Michigan feel about this new law? As it turns out, not everyone was excited about it…

Not everyone agrees with the newest ban on flavored vaping

American Vaping Association president Gregory Conley made a statement expressing his frustration at what he believes will be a negative impact on the state’s economy. “This shameless attempt at backdoor prohibition will close down several hundred Michigan small businesses and could send tens of thousands of ex-smokers back to deadly combustible cigarettes.” And he’s not the only person upset by the ban.

Are the rights of Michigan residents being violated by the ban?

State Rep. Beau LaFave says the Governor’s ban is violating the rights of Michigan adults. “In a dark smoke-filled backroom, Emperor Whitmer has banned smoking alternatives for adults. This is a non-democratic process by which Emperor Whitmer has decided to bypass lawmakers to completely ignore the rulemaking process … and has manufactured a crisis for political gain.” And he might just be right. At the time this article was posted (10/23/19) a federal judge has put a ban on enforcing Michigan’s new law. We’ll see how this turns out.

‘Vaping’ has been linked to lung disease, cancer, and death

Recent studies show that lab rats who inhaled the vapors found in e-cigarettes did in fact develop lung cancer. In addition, the CDC says that more than 200 people in 23 states have been affected by lung illnesses that are directly tied to e-cigarette use. In addition, the FDA reports that the fastest rising demographic for e-cigarette use is teens. And Michigan is no exception. Walk down any busy street in Grand Rapids, Hillsdale or Lansing or Mount Clemens and chances are you’ll see young people vaping.

Many teens admit to using vape products these days…

Currently, about 3.62 million middle and high school students use e-cigarettes across the nation, and the numbers are equally disturbing in Michigan. The reason? Most young users said it was the wide range of delicious flavors that made them so appealing. So it should come as no surprise that Governor Whitmer was in a hurry to sign off on any laws that made e-cigarette use less appealing to teens. And based on studies, that means curbing the use of flavored vaping products.

Be extra careful when buying or selling vape products in Michigan in future.

As we mentioned previously, the ban is currently only in place for six months, and at that time the governor will decide whether or not she wants to renew it. But during that half year, anyone buying or selling or even using flavored vape products could be looking at a lot of legal trouble.
